Officers responded to an apartment complex in reference to an attempted burglary in progress. Upon arrival, Officer made contact with the subject who was essentially refused to answer officer's questions and follow lawful commands. It appeared that the subject was under the influence of some type of drug which was later confirmed through further investigation. Since the subject was refusing officer's directions and refusing to answer questions, the officers had sufficient articulable reasonable suspicion to detain him and likely probable cause to arrest for loitering and prowling. Based on the subject's size (approximately 227 pounds), the likelihood that he was under the influence of drugs and likelihood that they would have to go hands on to detain him the officer completed an upper body wrap of the subject which was successful.
